Welcome to VidDarpan. These Terms and Conditions ("Terms") govern your access to and use of the VidDarpan application, website, and related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the Service.

1. Definitions

  • Company, We, Us, or Our refers to VidDarpan.
  • Service refers to the VidDarpan application, website, and related services.
  • User, You, or Your refers to any individual or entity accessing or using the Service.
  • School refers to an educational institution registered on the Service.
  • Account refers to a user account created to access the Service.

2. Eligibility

You must be authorized by a registered School or otherwise legally capable of entering into a binding agreement to use the Service.

If you are under the age of 18, your use of the Service must be supervised or authorized by a parent, guardian, or educational institution.

3. User Accounts

To access certain features of the Service, you may be required to create an Account.

You agree to:

  • Provide accurate and complete information.
  • Maintain the confidentiality of your login credentials.
  • Notify us immediately of any unauthorized access to your Account.
  • Accept responsibility for all activities conducted through your Account.

We reserve the right to suspend or terminate Accounts that violate these Terms.

4. Acceptable Use

You agree not to:

  • Use the Service for unlawful purposes.
  • Upload or distribute malicious software, viruses, or harmful code.
  • Attempt to gain unauthorized access to the Service or its systems.
  • Interfere with the operation or security of the Service.
  • Use the Service to harass, abuse, threaten, or harm others.

5. School Data and Ownership

Schools retain ownership of the educational records, student information, attendance records, notices, academic data, and other content uploaded to the Service.

VidDarpan acts as a service provider and does not claim ownership of School data.

Schools are responsible for ensuring that they have obtained all necessary permissions and consents required by applicable laws before uploading or processing personal data through the Service.

6. Privacy

Your use of the Service is also governed by our Privacy Policy.

By using the Service, you acknowledge that you have read and understood our Privacy Policy.

7. Intellectual Property

The Service, including its software, design, branding, logos, features, content, and technology, is owned by VidDarpan and protected by applicable intellectual property laws.

You may not:

  • Copy, modify, distribute, reverse engineer, or create derivative works from the Service.
  • Use VidDarpan trademarks, logos, or branding without prior written consent.

8. Subscription and Payments

Certain features of the Service may require payment of subscription fees.

By purchasing a subscription, you agree to:

  • Pay all applicable fees.
  • Provide accurate billing information.
  • Authorize applicable payment processing.

Unless otherwise stated in a written agreement, subscription fees are non-refundable.

9. Service Availability

We strive to provide reliable access to the Service but do not guarantee uninterrupted or error-free operation.

We may:

  • Modify, suspend, or discontinue any part of the Service.
  • Perform maintenance that may temporarily affect availability.
  • Update features and functionality without prior notice.

10. Third-Party Services

The Service may integrate with third-party providers including cloud hosting, messaging services, payment processors, analytics providers, or communication platforms.

We are not responsible for the availability, content, or practices of third-party services.

11. Limitation of Liability

To the maximum extent permitted by law, VidDarpan shall not be liable for:

  • Indirect, incidental, special, or consequential damages.
  • Loss of profits, revenue, data, goodwill, or business opportunities.
  • Unauthorized access to user accounts resulting from user negligence.

Our total liability shall not exceed the amount paid by the School or User for the Service during the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless VidDarpan, its founders, employees, partners, and affiliates from any claims, damages, liabilities, costs, or expenses arising from:

  • Your use of the Service.
  • Your violation of these Terms.
  • Your violation of applicable laws or third-party rights.

13. Termination

We may suspend or terminate access to the Service immediately if:

  • You violate these Terms.
  • Required by law.
  • Necessary to protect the security or integrity of the Service.

Upon termination, your right to use the Service will cease immediately.

14. Disclaimer

The Service is provided on an "AS IS" and "AS AVAILABLE" basis.

VidDarpan makes no warranties, express or implied, including but not limited to:

  • Merchantability.
  • Fitness for a particular purpose.
  • Non-infringement.
  • Continuous availability or error-free performance.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India.

Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in Uttar Pradesh, India.

16. Changes to These Terms

We reserve the right to modify these Terms at any time.

Updated Terms will be posted on this page with a revised "Last updated" date. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
